BioProfile terms of use

  1. Who and what. These terms apply to the use of the BioProfile software on app.bioprofile.com and bioprofile.com, including the free health scan, your account, your plan and the parts you buy. BioProfile is a business of 95 Bulls B.V., Kabelweg 57, 1014 BA Amsterdam, KvK 82254753. For purchases in the Superfoodies webshop, the general terms and conditions of Superfoods B.V. apply, which are on that webshop.
  2. Age. You must be 16 or older. For lab testing, 18 or older.
  3. No medical care. BioProfile gives an analysis, advice and guidance in the area of lifestyle, nutrition and supplements. It is not a diagnosis and not a treatment, and it does not replace a doctor. If the scan shows a notice to go to a doctor, follow it. In an emergency, call 112. If you use medication, are pregnant or have a condition, talk to your doctor before you follow any advice.
  4. Your account. You give correct details and keep your login details to yourself. You are responsible for what happens with your account. You can always have your account deleted via support@bioprofile.com.
  5. Fair use. You use the software only for yourself, not to copy it, to disrupt it or to collect other people’s data. If you misuse it, we may block your account.
  6. Experts. If you choose an expert, that expert gives the advice under their own responsibility. BioProfile puts you in touch and provides the software.
  7. Purchases. Prices and what you get are stated on the page of the offer and at checkout. You buy from 95 Bulls B.V. (VAT number NL862396633B01). With a purchase made at a distance you have a 14 day cooling-off period. For digital content you receive straight away, such as your personal plan, that cooling-off period only lapses if you expressly agree to this at checkout and declare that you know you lose your cooling-off period by doing so (article 6:230p of the Dutch Civil Code); if the checkout screen does not ask you for that, you keep your cooling-off period. If a service has already started at your request during the cooling-off period, then on withdrawal you pay proportionately for what has already been delivered. Subscriptions and programmes can be cancelled as stated with the offer.
  8. Availability. We do our best to keep the software working well and safely, but we cannot promise that it always works without interruption. We may improve or change parts of it.
  9. Liability. BioProfile is not liable for damage because you follow advice without consulting your doctor where these terms ask you to, or for indirect damage. Our liability is limited to the amount you paid BioProfile in the twelve months before the damage. This limit does not apply in the case of intent or gross negligence by BioProfile, and not in so far as the law forbids a limit.
  10. Intellectual property. The software, the texts and the questionnaire belong to BioProfile or its licensors. You may use your plan for yourself.
  11. Privacy. How we handle your data is set out in our privacy statement; which cookies we use is set out in our cookie statement.
  12. Complaints. Email a complaint to support@bioprofile.com; we answer within 14 days. If we do not work it out together, you can go to the competent court.
  13. Changes. We can change these terms. We tell you at least 30 days in advance about a change that is to your disadvantage; you can cancel your account then.
  14. Law. Dutch law applies. As a consumer you keep the protection of the mandatory rules of the country where you live.
